Shapiro also asserted that the government has not proven that conversations conducted using various inmates’ PACs were any different than conversations using Combs’ own number. She argued that conditions at MDC hampered Diddy’s ability to mount a meaningful defense.

“If anything, the fact that Mr. Combs needed to use the shared minutes demonstrates that conditions at MDC did not permit adequate defense preparations,” Shapiro stated.

“While this is not technically permitted by BOP policy, the BOP effectively sanctions this behavior and all calls are monitored.”

There is an approval process that occurs after inmates submit contact lists, and inmates cannot share access codes for their phones, the BOP said.

According to BOP guidelines, prisoners should not have access codes to another prisoner’s phone and must report immediately if someone is able to access their codes.

Diddy is also facing serious charges, pending trial related to sex trafficking, racketeering and transporting prostitutes.

He pleaded not guilty to all charges. Friday will be the fifth time he has sought bail before the court.
