Sean “Diddy” Combs is fighting charges that he trafficked in sex and committed fraud, citing the federal case against him as racially charged.
As for the bail request, filed in court Monday and obtained by Fox News, his attorneys said Combs has every right to comment on the prosecution.
“He has the right to a fair trial and the constitutional right to speak on his behalf,” the defense wrote in a letter to Judge Arun Subramanian.
Diddy’s legal team added: “The government’s argument for requiring his children to post birthday wishes on Instagram and his lack of right to publicly express his views that this prosecution has racially motivated, quite simply, an unconstitutional attempt to silence him.”
Combs is currently in pre-trial detention and his trial is set for May 5, 2025.
Prosecutors said Combs carried out his campaign from behind bars using other inmates’ phones that he collected using contraband communications methods banned in prison.
In support, they provided instances of past behavior in which Combs intentionally threatened employees and abused intimate partners, claiming a long history of violence.
Prosecutors added that former employees described instances where the defendant threatened to kill them and hit them in the face.
“This significant history of violence must be taken into account when considering the defendant’s obstructive conduct,” they said.
The case has become a focal point for those with underground political views, as U.S. Attorney for the Southern District of New York Damian Williams will resign on December 13 when President-elect Donald Trump takes office.
Her replacement, a former first-term Biden-Harris appointee, is Jay Clayton, former chairman of the Securities and Exchange Commission.
The claws came out – hard – for Combs when his ex, Cassie Ventura, just 29 years old, made serious allegations against him in an investigation that began in December 2023.
The two reached a quick settlement in her lawsuit, but he has since faced other charges, including more than 100 people reportedly seeking to sue Combs for a series of claims.
The strategy included allusions to what they described as racial bias in Combs’ treatment during previous interactions with law enforcement.
Combs’s ex, Misa Hylton, once beat up heavy-handed Homeland Security agents who burst through the locked gates of Combs’ residence.
With both sides preparing for a courtroom showdown — as federal prosecutors are opposing Combs’ release as a potential danger to witnesses — the case is ongoing has gotten worse. Now, the court is considering Combs’ third attempt at bail.
